In a recent ruling, the Rivers State High Court has dismissed a case against 25 lawmakers, citing lack of jurisdiction and locus standi.
Presiding Judge, Hon. Justice Okogbule Gbasam, ruled that the claimants lacked the legal standing to institute the suit, despite procedural correctness.
The suit, filed by Mr. Hycenth Amadi and others, sought interpretation of the law and challenged the status of the 25 lawmakers. However, the court held that the lawmakers never lost their seats and their actions remain valid.
The judge’s ruling was based on jurisdiction, affirming the Federal High Court’s judgment as binding. The case was dismissed, and the lawmakers were exonerated.
The parties involved in the suit included Mr. Hycenth Amadi and others as claimants, and RT. Hon. Martin Chike Amaewhule and 24 others, the Governor of Rivers State, Siminalayi Fubara, the Attorney General of Rivers State, and the Rivers State House of Assembly as defendants.
