The tribunal, led by Justice H N Kunaza, found merit in Agbo’s petition and annulled the 2,000 votes added to Simon Atigwe’s tally.
Enugu, Nigeria – The House of Representatives tribunal has nullified the election of Rt. Hon. Simon Atigwe, member representing Igboeze North/Udenu federal constituency, and declared Labour Party candidate, Hon. Dennis Agbo, the rightful winner.
Atigwe, of the Peoples Democratic Party (PDP), was initially declared the winner of the February 3rd, 2024 re-run election with 23,863 votes, ahead of Agbo’s 23,226 votes. However, Agbo challenged the result, citing irregularities and non-compliance with the electoral act.
The tribunal, led by Justice H N Kunaza, found merit in Agbo’s petition and annulled the 2,000 votes added to Simon Atigwe’s tally.
The court restored the original votes from the February 25th, 2023 election, giving Agbo 28,870 votes and Atigwe 14,229 votes.
The tribunal declared Agbo the actual winner with 23,221 votes, surpassing Atigwe’s 21,863 votes. Consequently, the certificate of return issued to Atigwe has been ordered withdrawn and issued to Agbo instead.
