The Nigeria Police Force has provided clarification regarding the arrest of individuals engaged in crossdressing, stating that current Nigerian laws do not prohibit crossdressing itself.
The Police spokesperson, Olumuyiwa Adejobi emphasized that crossdressers like Idris Okuneye, popularly known as Bobrisky, cannot be arrested unless there is credible evidence of them committing a crime.
Speaking on Channels Television’s “Politics Today” program on Tuesday, April 2, Adejobi addressed concerns raised by Nigerians regarding the moral implications of crossdressing, particularly in light of Bobrisky being recognized as the best-dressed female at a recent movie premiere by Eniola Ajao.
Adejobi clarified that while Nigerian law does prohibit same-sex marriage and acts of homosexuality, individuals cannot be prosecuted solely based on their appearance or identity as a crossdresser. He emphasized that the police can only take action if crossdressers are caught engaging in illegal activities.
In response to the question “Can Police arrest Bobrisky?” Adejobi explained that, like proving a rape case in court, there must be sufficient evidence to support the charges. Mere allegations without credible evidence are not grounds for arrest or prosecution.
While acknowledging societal concerns about crossdressing, Adejobi underscored the importance of upholding the rule of law and ensuring that individuals’ rights are protected. He reiterated that the burden of proof lies with law enforcement agencies to gather convincing evidence before taking legal action against crossdressers.
The police spokesperson emphasized the need for a thorough investigation into any allegations against crossdressers before any legal action is taken. He highlighted the principle of innocent until proven guilty and emphasized that individuals should not be prejudged or discriminated against based on their appearance or lifestyle choices.
Adejobi’s comments shed light on the complexities surrounding the issue of crossdressing in Nigeria and the legal framework governing such matters. While societal attitudes may vary, the rule of law remains paramount in determining the legality of individuals’ actions.
As debates continue regarding the moral and cultural implications of crossdressing, Adejobi’s statements serve as a reminder of the importance of adherence to legal procedures and the necessity of evidence-based decision-making in law enforcement.
