Port Harcourt, Nigeria – A Rivers State High Court in Port Harcourt has issued an ex-parte order stopping the national leadership of the All Progressives Congress (APC) from proceeding with the scheduled ward, Local Government, and state congresses in Rivers State.
These congresses were originally set for October 11, 16, and 26, 2024, respectively.
This legal development follows a recent ruling by the same court, which nullified the removal of the Emeka Beke-led State Executive Committee and reinstated it. However, instead of complying with this order, the APC’s national leadership declared its recognition of the Tony Okocha-led Caretaker Committee in the state.
The restraining order was granted in response to a lawsuit filed by Peter Ohochukwu and Hajia Ndidi-Chukwuma on behalf of themselves and all elected executive members of the APC in Rivers State.
The defendants in the case include the APC National Chairman, Abdullahi Ganduje; the National Secretary, Ajibola Bashiru; the APC as a party; the Inspector General of Police; the Nigerian Police; and the Independent National Electoral Commission (INEC).
Justice Godwin Ollor, who presided over the case, ruled that the defendants are prohibited from conducting, supervising, holding, or monitoring any election to form a new Rivers State executive committee. The judge emphasized that his ruling was based on the merit of the application and the oral submission made by the plaintiff’s counsel, Collins Dike.
Additionally, the court barred the national leadership of the APC from suspending the Beke-led executive in Rivers State or interfering in its activities. The case has been adjourned until September 9, 2024, when the court will hear the motion on notice for interlocutory injunction.
