The document outlines how Trump and his allies, including lawyer Rudy Giuliani, allegedly tried to block the certification of President Joe Biden’s victory by inciting violence and chaos during the January 6 Capitol riot.
A ‘Private Criminal Effort’
Prosecutors accuse Trump of orchestrating a “private criminal effort” to cling to power, despite knowing his claims of election fraud were false. The 165-page filing details several instances where former Vice President Mike Pence expressed doubt over Trump’s voter fraud claims and urged him to accept defeat. Trump, however, continued pushing the narrative that the election was “rigged.”
One of the most striking revelations in the filing is that Trump allegedly planned to declare victory no matter the election outcome, laying the groundwork for legal challenges to Biden’s win.
Delays Push Trial Beyond Election Day
Trump’s legal team has until November 7 to respond to the filing—two days after the 2024 presidential election. If Trump wins, he may seek to have the charges dropped. Despite the delays, prosecutors are determined to see the case go to trial, with Smith calling it a pivotal opportunity to hold Trump accountable for his “private crimes.”
The former president, facing four criminal cases since leaving office, maintains that the charges are part of a political strategy to damage his 2024 campaign. He has repeatedly called the 2020 election “rigged,” despite no evidence supporting widespread voter fraud.
New Evidence Against Trump Campaign
The court document also reveals new evidence about Trump’s alleged efforts to undermine the election results in key battleground states. His campaign team reportedly sought to challenge mail-in ballots and exploit the chaos of January 6 to delay the certification process.
