Late Justice Moses Bello’s daughter challenges Will in court

Ann Eniyamire, the daughter of the late President of the Customary Court of Appeal in Abuja, Justice Moses Bello, has taken legal action against the executor of her father’s will.

Eniyamire alleges that she was unfairly treated in the distribution of her father’s assets.

In a suit filed at the Federal Capital Territory High Court in Bwari, Eniyamire claims that the executor, Reverend Father Ezekiel John and Christ the King Catholic Church Okene Parish, deviated from her father’s instructions regarding the distribution of his properties.

Justice Moses Bello’s will reportedly stipulated that his assets should be divided among his wife and eight children using an 11.11 per cent sharing formula. However, Eniyamire alleges that only a 4.16 per cent sharing formula was adopted, depriving her of her rightful share.

Through her lawyer, Yahuza Mahraz, Eniyamire has petitioned the court to declare her entitlement to 11.11 per cent of her late father’s properties, including his estates. She also seeks to invalidate the decision of the defendants and relieve them of their duties as executors of her father’s will.

Among her requests to the court are an order for the defendants to account for and hand over all necessary documents related to the management and distribution of her father’s estates, as well as compensation of N500,000,000.00 as general damages.

In response, the defendants have engaged lawyer Adewale Adegboyega to challenge the competency of the suit. The case, presided over by Justice M.A Madugu, has been adjourned until June 4 for both the preliminary objection and the substantive suit to be heard.
